The "Three-Hour" Rule
Timing is the first pillar of compliance. Under NC Gen. Stat. § 18B-1114.7, consumer tastings must:
- Occur only between 1:00 PM and 7:00 PM.
- Last no longer than three (3) hours, excluding setup and cleanup.
- Be approved by the local ABC Board prior to the event at any store location.
Pouring by the Numbers
The most common point of failure for new brands is the pour size. In an NC ABC store, accuracy is non-negotiable:
- Single Sample Limit: Exactly 0.25 ounces of any product made available for sampling.
- Daily Total: A consumer cannot exceed 0.5 ounces of spirituous liquor at an ABC store event in a single day. (Note: This is more restrictive than the 1.0 oz limit allowed at other special event venues ).
Personnel & Professionalism
Our brand ambassadors are more than just friendly faces; they are an extension of you and legally responsible for the event's integrity:
- Age Requirements: All individuals pouring or distributing liquor must be at least 21 years old.
- Vigilance: Agents must verify that the customer is 21+ and does not appear visibly intoxicated.
- Dress Code: We maintain a strictly professional appearance; no shorts or jeans are permitted during tastings.
- Conduct: Agents are strictly prohibited from consuming products owned by the brokerage or its clients during the event.
Marketing within the Lines
While public advertising of specific store events is generally restricted, you can build significant brand equity inside the store:
- Branded Merchandise: You may give away "advertising specialties" like shot glasses, hats, and t-shirts, but these items cannot be sold.
- Approved Signage: Flyers and posters are allowed if they are not handwritten and the draft is pre-approved by the ABC Board.
- Atmosphere: Please note that music or sound amplification is not permitted during the tasting event.
